Terms of Service

1. Acceptance of Terms

By accessing or using the kodeee website and services, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any part of these terms, you must not use our services.

2. Data Collection and Usage

We collect data for business purposes including but not limited to:

  • Account creation and authentication information (name, email, phone number)
  • Payment processing information
  • Service usage analytics
  • Communication preferences

We only store hashed passwords in our database. All other information is stored in plain text for business operations. By checking the agreement checkbox during signup, you accept all terms and conditions, terms of service, and privacy policy.

3. Payment and Pricing Policy

Our pricing structure is as follows:

  • Basic Plan (₹999/month): Domain hosting and other charges are the responsibility of the client. The ₹999 is for website management charges as described in the pricing section.
  • Standard Plan (₹1999/month): Non-cancellable for 20 years
  • Premium Plan (₹4999/month): Non-cancellable for 30 years
  • Enterprise Plan (₹10000+/month): Non-cancellable for 40 years
    Domain hosting and other charges are the responsibility of the client.

If you request a refund, we will process it only if the client requests it within 24 hours of payment. After 24 hours, no refund will be possible as the work will have already started. Approved refunds will be processed within 7 days.

4. Website Development and Management

When you select any of our plans, we provide AI-made websites as part of our free development service. The effort and cost involved in creating these websites is our responsibility.

If a client wishes to cancel their plan mid-term, they must pay the one-time development cost based on current market rates:

  • Standard Plan (₹1999/month): Non-cancellable for 20 years
  • Premium Plan (₹4999/month): Non-cancellable for 30 years
  • Enterprise Plan (₹10000+/month): Non-cancellable for 40 years

Important Cancellation Policy: If a client wishes to cancel their subscription before the designated period (20, 30, or 40 years), they must pay the full one-time development cost based on current market conditions. This includes:

  • The current market value of the website/application/software development
  • All improvements, features, and management efforts provided until now
  • The remaining subscription amount for the current month
  • GST charges on the total amount

For example, if a website was originally developed for ₹50,000 and the client has been using our Premium Plan (₹4999/month, non-cancellable for 30 years), but now wishes to cancel:

  • If the current market value of the website is ₹70,000 due to improvements and added features
  • The client must pay this updated one-time development cost (₹70,000)
  • Plus the current month's management charges (₹4999)
  • Plus applicable GST on the total amount

We determine the current development cost based on market conditions, improvements, and features added. The client cannot negotiate this amount. If the client does not pay the required amount, they must continue paying their regular subscription fees. Failure to pay either the cancellation fee or subscription fees may result in legal action.

Only after paying the full one-time development cost plus current month's subscription fee and GST can the client cancel their plan before the designated period ends.

5. Pricing Modifications

We reserve the right to modify our pricing at any time based on:

  • Market conditions and trends
  • Increasing costs of hosting, domains, or software
  • Changes in technology or service delivery
  • Offline and online market fluctuations

Such modifications are mandatory and will be communicated to clients in advance when possible.

6. Client Responsibilities

If a client does not have active website management with us or if they have made a one-time payment without ongoing management, they are responsible for:

  • Website maintenance and updates
  • Domain and hosting management
  • Email configuration and management
  • Any issues, errors, or design problems

We are not liable for any problems that arise with websites not under our active management.

7. Limitation of Liability

kodeee shall not be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

  • Your access to or use of or inability to access or use the services
  • Any conduct or content of any third party
  • Any content obtained from the services
  • Unauthorized access, use or alteration of your transmissions or content

8. Changes to Terms

We reserve the right to modify these terms at any time. Changes will be effective immediately upon posting on our website. Your continued use of our services after any changes constitutes acceptance of the new terms.

9. Governing Law

These terms shall be governed and construed in accordance with the laws of India, without regard to its conflict of law provisions.
